Patients’ Bill of Rights Update

On June 29, the Senate passed a Patients’ Bill of Rights that includes the right to challenge, in both state and federal courts, decisions made by insurers. President Bush has threatened to veto that legislation.

At press time, the House continued to struggle with the issue. There are two bills in the House—one that is similar to the Senate legislation and one that limits appeals to state courts as well as damages that successful litigants can receive.

The House leadership and the White House are trying to rally support for the second bill. A vote could be postponed until after Congress returns from the August recess.
